TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of PLINKY PLONK, a UK court-sports marketplace ("Platform") operated by PLINKY PLONK ("we", "us", "our"). By creating an account, booking a court, or using the Platform in any way, you agree to these Terms.

1. What PLINKY PLONK is

PLINKY PLONK is a marketplace connecting players with venues and coaches across the UK for pickleball, padel and tennis. We facilitate discovery, booking and payment. Where we act as a marketplace, the underlying court hire or coaching service is provided by the venue or coach, not by us.

2. Accounts

• You must be at least 18, or have parent/guardian consent.
• You are responsible for keeping your login credentials secure.
• You must provide accurate details and keep them up to date.
• We may suspend or close accounts that breach these Terms.

3. Bookings

• A booking is confirmed only when payment is captured and you receive a confirmation email.
• You are responsible for arriving on time and following the venue's rules.
• Late arrival does not extend the booking.
• Venues may impose additional terms (dress code, kit hire, etc.) which are shown at the point of booking.
• Some venues on PLINKY PLONK manage their availability through their own or third-party booking systems. Where this applies, your booking made on PLINKY PLONK will be passed to that system to confirm and manage your session. Your booking and payment remain with PLINKY PLONK and are covered by these terms.

4. Payments, fees and commission

All payments are processed on-platform through PLINKY PLONK Pay. Prices are shown in GBP and include VAT where applicable.

• Standard platform commission — PLINKY PLONK charges a flat 10% commission per booking on all bookings and coaching sessions paid through the platform. The venue or coach receives the balance after our commission.
• Direct sessions run by PLINKY PLONK — including our own coaching, socials and Saturday sessions — are provided by us. The full fee is retained by PLINKY PLONK and no third-party marketplace commission applies.
• Coach-only bookings where the coach owns the session (venue hire arranged separately) — the platform fee applies to the coaching fee only.
• Payment processor fees are absorbed by PLINKY PLONK unless stated otherwise.

5. Cancellations and refunds

• By you: cancellations more than 24 hours before start time are refunded in full. Within 24 hours, the booking is non-refundable unless the venue/coach agrees.
• By venue or coach: if a session is cancelled you receive a full refund automatically.
• By PLINKY PLONK: we may cancel for force majeure (weather, safety, court closure) with a full refund.
• Refunds are returned to the original payment method, typically within 5–10 working days.

6. Player conduct

You agree to:

• Respect other players, coaches, venue staff and equipment.
• Not use the Platform for anything unlawful, abusive or fraudulent.
• Not resell bookings without our written consent.
• Not scrape, reverse-engineer or interfere with the Platform.

7. Venues and coaches

• Venues and coaches are independent operators. They warrant that they hold the licences, insurance and qualifications required to deliver their service in the UK.
• Venue/coach terms (payout schedule, commission, exclusivity) are set out in a separate Partner Agreement.
• Listings must be accurate. False or misleading listings will be removed.
• Payouts are made by our payment processor on the schedule stated in the Partner Agreement.

8. Referrals and affiliates

Referral credits and affiliate rewards are governed by the specific programme's terms shown on the Refer and Venue Affiliates pages. Rewards have no cash value and may be revoked in cases of abuse.

9. Injury, health and assumption of risk

Pickleball, padel and tennis carry a risk of injury. You participate at your own risk and confirm you are physically fit to play. To the maximum extent permitted by law, PLINKY PLONK is not liable for injuries sustained on court.

10. Intellectual property

All Platform content, software, branding, characters, design, trade dress and underlying ideas are owned by PLINKY PLONK or its licensors and are protected by copyright, trademark, database right and other UK and international laws.

• Trademarks — PLINKY PLONK, the PLINKY PLONK logo, the Pickle, Paddy and Ace mascots, the tagline "Book a court. Show up. Play." and the distinctive brand colours (Plink Yellow, Smash Orange, Court Black and Chalk) are trademarks of PLINKY PLONK. They may be registered or unregistered. All rights reserved.
• What you may not do — you may not use, copy, modify, reproduce, distribute, publicly display, create derivative works from, reverse-engineer, scrape, or exploit any part of the Platform or its branding without our prior written permission. This includes our name, logo, mascots, user interface, layout, colour scheme, code and marketing copy.
• User content — you retain rights to content you submit (photos, reviews, comments) and grant us a worldwide, royalty-free, sublicensable licence to use, display and distribute it on the Platform and in marketing materials.
• Reporting misuse — to report unauthorised use of PLINKY PLONK branding or content, email hello@plinkyplonk.app.

11. Liability

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law. Subject to that, our total liability for any claim is capped at the amount you paid through the Platform in the 12 months before the claim. We are not liable for indirect or consequential loss.

12. Termination

You can close your account at any time. We may suspend or terminate access immediately for breach of these Terms, non-payment, or where required by law.

13. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes

We may update these Terms. Material changes will be notified by email or in-app notice at least 14 days before taking effect.
